Hartman Simons partner Peter Hartman was a guest on a recent episode of the nationally syndicated “Commercial Real Estate Show” radio program. The topic was “OOPS! Should Have Covered That in the Lease,” and the episode touched on various items that are frequently left out of commercial real estate leases.

Hartman told host Michael Bull that it's important to be extremely thorough and diligent during the crafting of a lease, as many leases can last up to 30 years and the landlord can change during that time. Hartman also mentioned the importance of using a lawyer when negotiating leases so that a tenant — especially a smaller or mom-and-pop one — is aware of any hidden costs or fees beyond just the rent. “If you only do a lease or so a year, you have no idea what to look out for,” he said.
